TECHNICAL REGULATIONS OF UKRAINE / CONFIRMATION OF COMPLIANCE / MARKING OF CONFORMITY

Ukraine’s European integration led to the refusal to certify products under the UkrSEPRO system and confirmation of their compliance with the technical regulations. Such regulations in Ukraine are subject to the Law of Ukraine “On Technical Regulations and Conformity Assessment”, which defines the legal and organizational framework for the development, adoption and application of technical regulations and the conformity assessment procedures provided for by them, as well as the implementation of voluntary conformity assessment.
The technical regulations of Ukraine are harmonized with the New Approach Directives of the European Union in terms of technical requirements and conformity assessment procedures. Compliance with the requirements of the Technical Regulations (TR) is mandatory.
The conformity mark must be applied to all products that have passed the conformity assessment procedure. For each type of product, a Technical Regulation and a conformity assessment module are selected. To confirm a product compliance, it may be necessary to do: samples testing, type testing, expert audit of a production site, analysis of technical documentation, quality control of the production process, etc., depending on the degree of product hazard.
Certificate of Conformity
Voluntary conformity assessment (voluntary certification) in accordance with Section VI of Article 24 of the Law of Ukraine “On Technical Regulations and Conformity Assessment” is carried out on a voluntary basis, in any form, including testing, declaration of conformity, certification and inspection and for compliance with any stated requirements.
Declaration of Conformity
Declaration of Conformity is a mandatory document verifying the conformity of products to the requirements of the Technical Regulations. Registration of the declaration of conformity is carried out by accredited certification bodies. The conformity assessment module is determined by the requirements of a specific technical regulation.

Ukrainian Conformity Mark
Products that have passed the procedure of compliance with the Technical Regulations of Ukraine are marked with a label conformity. The conformity mark is applied only to products that fall within the scope of technical regulations. The form, description, rules and conditions for applying of a such mark are regulated by the Decree of the Cabinet of Ministers of Ukraine dated December 30, 2015 No. 1184.
Rules and conditions for applying the Ukrainian conformity mark
The mark of conformity shall be applied to the product or its data plate in such a way that it is visible, legible and indelible. If this is impossible or unjustified due to the nature of the product, the conformity mark is applied to the packaging and accompanying documents, if such documents are provided for by the relevant technical regulations.
The sign of conformity needs to be applied before the introduction of products into circulation. The conformity mark may be accompanied by a pictogram or any other sign indicating a particular risk or use.
The conformity mark is accompanied by the identification number of the designated conformity assessment body, if such body was involved at the production control stage (carried out conformity assessment work).
The height of the mark of conformity may not be less than 5 millimeters, unless otherwise provided by the relevant technical regulation.
Images of the sign of conformity can be flat or embossed and are made in two contrasting colors.

Conformity Assessment Procedure
- Definition of the relevant technical regulations and standards. Often, products are subject to not one, but several Technical Regulations. In this case, a declaration must be registered for each of them.
- Definition of a conformity assessment module.
- Clarification of special provisions for labeling, packaging and disposal.
- Development of a technical file.
- Product testing.
- Conducting an independent assessment by a third party, a certification body.
- Drawing up a declaration of conformity.
- Marking products with a conformity mark.
What Information Does a Declaration Contain?

- Name, address and contact details of the product manufacturer.
- Name, address and contact details of the representative company in Ukraine.
- Full name and position of the responsible person who signed the declaration of conformity.
- Name, brand, model, type or serial number of the product.
- A list of agreed standards or approved technical solutions that were used in the manufacture of products.
- Information about test reports.
- Information about the technical regulations.
- Information about the certification body that carried out the conformity assessment.
- Date and number of the declaration of conformity.
